LEGAL NOTICE
Kumonet, in compliance with the Information Society Services and Electronic Commerce Law 34/2002, of 11 July (LSSI-CE), states that:
1. Its corporate name is FIBRATEL S.L., with tax ID B-80444508. Its registered address is: Calle Xaudaró, 11, 28034, Madrid and is duly listed on the Commercial Register in Madrid, Volume 4,756, Book 0, Folio 107, Section 8, Sheet M-78.068, first inscription. Additionally, Fibratel's Customer Service team is available for free from Monday to Thursday from 8:00 until 18:00 and from 8:00 to 14:00 on Friday's, except for bank holidays. 2. The domain, "www.kumonet.es" is the property of and is registered to Fibratel S.L. Its objective is to provide the general public with information on the Kumonet platform. Its tool allows Fibratel's duly registered customers to manage the different products and services offered by Fibratel. These general conditions regulate the access to and use of the "www.kumonet.es" website (hereinafter, "the Site") that Fibratel S.L. makes available to its users.
3. Accessing the site implies full acceptance of these conditions, notwithstanding the general or specific conditions set out for given or particular services, and which will be understood as accepted by simply using them.
4. The intellectual property rights on the "www.kumonet.es" website belong to Fibratel S.L. These include its source code, design, browsing structure, databases and the different elements in the contents. The exclusive rights to use these in any way, especially through rights for reproduction, distribution, public communication and alteration belongs to Fibratel S.L.
5. Viewing, printing and partially downloading the content of the Site is only and exclusively authorised if the following conditions concur:
• Compatibility with the aims of the Site
• Exclusive intention to obtain the information contained for personal and private use. It is expressly prohibited to use the content for commercial ends or for distribution, public communication, alteration or decompilation.
• Regarding the integrity of the Site's contents, it is expressly prohibited to make any alterations to them.
• The graphics or images available on the Site cannot be used separately from the text or the rest of the images that may accompany them.
6. Fibratel S.L. reserves the right to make changes and updates to the information contained on the Site, to its configuration and design and to the access conditions at any time and without needing to give prior notice.
7. Fibratel S.L. does not guarantee that there will be no interruptions or errors when accessing the Site or its content, or that it will be up to date. However, it commits to carrying out any tasks aimed at rectifying errors, re-establishing communication and updating the content as soon as it receives notification of the errors, disconnections or out of date content. This is as long as there is nothing to make it impossible or difficult to achieve.
8. Both accessing the Site and any undue use that can be made of the information contained on it is the exclusive responsibility of the person doing so. Fibratel S.L. will not be responsible for any consequence, damage or harm that could be derived from the said access or use. Nor does Fibratel S.L. accept responsibility for any security errors that might arise; for the damage that can be caused to the user's computer system (hardware and software), or to the files or documents stored on it, as a result of:
• The presence of a virus on the user's computer used for connecting to the services and content on the Site.
• A malfunctioning browser.
• Using out of date versions of the browser.
9. Fibratel S.L. does not accept any responsibility for the contents linked to from the Site, as long as they are not on it. Nor does it guarantee the absence of viruses or other elements on them that may cause alterations to the user's computer system (hardware and software), or to the files or documents on it. This excludes any responsibility for damage of any nature caused to the user for this reason. In the event of any user, customer or third party considering that the content or services offered on the pages linked to are illegal or adversely affect the property or rights of the user in question, of a customer or of a third party who may be entitled to compensation and, in particular, consist of:
• Activities or content likely to be considered criminal in accordance with the Spanish penal code.
• Activities or content that violate industrial or intellectual property rights.
• Activities or content that endanger public order, criminal investigation, public safety and national defence.
• Activities or content that endanger the protection of public health, the respect for personal dignity and the principle of non-discrimination and the protection of health and infancy.
The user shall send an email to "info@fibratel.com" so that the administrators can start the appropriate proceedings in order to solve the relevant problems.
10. Fibratel S.L. is the owner of the intellectual property rights relating to their products and services. Regarding references to third party products and services, Fibratel S.L. acknowledges the industrial and intellectual property rights corresponding to the owners. Their mere presence or mention on the Site does not imply that Fibratel S.L. has any rights or responsibilities over them. Nor does Fibratel S.L. endorse, sponsor or recommend the said products and services, unless expressly stated otherwise.
11. Unauthorized use of the information contained on the Site, reselling it or undermining Fibratel S.L.'s intellectual property rights will give rise to legally established responsibilities.
12. Fibratel S.L. and the user will submit to the courts and tribunals in Madrid for any dispute that may arise from accessing or using the Site, and both expressly renounce any other venue.
